Trust Structure & Tax Planning Saves $130K in Tax

This client is one of Gladstones most respected air conditioning specialists, with more than a decade in business and around $1.5m turnover per year. They signed up for an annual service package so they could get tailored advice whenever they needed it. As part of this package, we did a tax planning session together. Annual tax planning involves sitting down with the client a couple of months before June 30, reviewing the current situation, and updating their projected profit based on upcoming expenses. Following this meeting, we were able to:
  • Project a $406K profit
  • Identify some accounting and tax measures we could put in place before EOFY to significantly reduce their taxable income
  • Reduce their profit by $262K to just $144K
Because we’d also set up a trust structure for this client, we were then able to carefully plan the trust distribution to the beneficiaries for maximum tax savings. This business went from potentially paying almost $150K in tax to the ATO to paying just under $19K for the financial year.

As a result, their total tax savings was around $130K.

Smarter Tax Planning Gets a $278K Tax Refund

This client operates a large recycling facility in the Gladstone region. They’d had a successful year in 2020, but paid the ATO $242K in income tax while working with a different accountant who didn’t do tax planning.

After a year of big changes in their business (and more changes to come), they were looking for a more proactive accountant that would support them with timely advice ahead of major business decisions.

We began supporting this client in early 2021. Our top priority was ensuring we did tax planning before end of financial year.

After reviewing their situation, we saw an opportunity to take advantage of some key tax legislation — namely, the Full Expensing/Instant Asset Write Off change and Loss Carry Back measures.

Based on equipment purchases the client had made in the 2021 financial year, we were able to:

  • Create a large income tax loss and carry it back to the 2020 financial year
  • Get back every single cent of income tax paid the previous financial year (all $242K!)
  • Plus get a refund of some tax paid in the 2021 financial year

This gave them a total tax refund of $278K.

As a result, this client was able to reinvest this money and purchase new assets and equipment to further grow their business operations.

$99K Tax-Free After 12 Months of ATO Appeals

This Canberra-based client operates in the cyber security space and holds a number of large government contracts. Their previous accountant who had set up the business in late 2019 wasn’t lodging activity statements on time or responding to phone calls and emails.

By March 2020, it became clear they’d need an accountant that would keep up with the constantly shifting environment. So, they came onboard with JTW Accountants in April 2020.

Unfortunately, this client had not received the Cashflow Boost — a mostly automatic process that should have happened after lodging the March 2020 quarter BAS. So, our major focus was on chasing these funds.

After numerous phone calls and correspondence with the ATO that culminated in lodging an official complaint in June 2020, we got the issue reviewed. We found that because the previous accountant had lodged the BAS 13 days late (and therefore no business income was reported prior to 12 March 2020), the government deemed our client ineligible.

Just before Christmas 2020, the Inspector General of Taxation released a report on the Administration of JobKeeper and Boosting Cashflow Measures (which discussed the criteria our client was deemed ineligible on).

After reading through this report in January 2021 and presenting a detailed analysis to our client, recommending that we demand an ATO review into the decision. The client agreed, kicking off the following timeline of events:

  • February 2021: We lodged the official review
  • March 2021: We heard nothing, so continued to follow it up with the ATO
  • April 29, 2021: Lodged an official Objection to the ATO decision to deny our client the Cashflow Boost
  • 1 June 2021: The ATO request additional information (due in 6 days)
  • 6 June 2021: Following a call with the client, we provided the additional info to the ATO
  • 17 June 2021: We were notified of the outcome… our client is eligible for the Cashflow Boost!
  • 22 June 2021: The Cashflow Boost was paid into the company’s bank account in full

As a result, our client received $99,600 in tax-free money.

It took 12 months of fighting the ATO and bloody hard work… but in the end, it was all worth it. And we live to fight the ATO another day!
